At MNP Consultores we have an area specialized in Administrative Law, dedicated to advising and representing companies in their relations with the Public Administration and in the defense of their rights against acts of authority.

We have extensive experience supporting private sector companies in legal risk management, regulatory compliance and the resolution of administrative disputes, such as: state liability, intellectual property, environmental, public servants, telecommunications, financial sector, among others.

Our multidisciplinary team is formed by lawyers with postgraduate studies in national and international universities, with extensive experience working in the Federal Court of Administrative Justice, the Federal Judiciary, the Tax Administration Service, the Taxpayer's Defense Attorney's Office, as well as the private sector, which makes us experts in the interpretation and application of administrative and procedural provisions, and allows us to develop high-precision legal strategies, aimed at minimizing risks, reversing improper resolutions and safeguarding our clients' assets and operational continuity in an integral manner.

We have experience serving national and transnational companies in various sectors, such as pharmaceutical, manufacturing, technology, construction, among others, as well as serving various municipal entities in several states of the Republic.  

  • Intellectual property. The defense of intellectual property matters includes the various procedures in industrial property and copyright matters before the Mexican Institute of Industrial Property, litigation before the specialized intellectual property court of the Federal Court of Administrative Justice, as well as civil and criminal litigation in order to achieve the protection of the intellectual property rights of our clients.
  • Federal Law for the Prevention and Identification of Operations with Illicit Proceeds. Preventive advice, compliance and legal defense in operations related to money laundering and financing of terrorism, in compliance with the obligations derived from the Federal Law for the Prevention and Identification of Operations with Illicit Proceeds (LFPIORPI) and other applicable regulations.
  • State's financial liability. We intervene in administrative and/or jurisdictional proceedings aimed at claiming compensation for damages caused by irregular acts of the public administration.
  • Environmental. We represent our clients against resolutions imposing fines, closures, suspension of activities or revocation of permits. Our defense is not only focused on the nullity of administrative acts, but also on the preventive analysis of regulatory compliance, mitigating risks and optimizing the operation of industrial, commercial or infrastructure projects.
  • Advice and attention to verification and inspection visits from federal, state and municipal authorities.
  • Attention and advice regarding actions and resolutions issued by various administrative authorities, such as the National Water Commission in matters of concessions and authorizations, the National Banking and Securities Commission, the Financial Intelligence Unit, Telecommunications and economic competition, among others.

Success stories

  • We obtained through a lawsuit the determination of patrimonial responsibility of the State for breach of its duty of custody due to the loss of a vehicle that was sent to a vehicle impound lot owned by the State, proving the material damage caused. 
  • We advised a municipality in the State of Jalisco, to duly resolve several observations made by the Federal Superior Audit Office (Auditoría Superior de la Federación). 
  • We advised several taxpayers on the recovery of municipal licenses that are essential for the operation and continuity of their economic activities.
  • We were able to obtain the suspension of closures and the refund of improperly imposed fines. Through the nullity trial in which the violation of the principle of typicity in the acts of the City Council was accredited, ensuring the operational continuity of the businesses.
  • We provided comprehensive advice in obtaining a concession for the exploitation of subsoil minerals, specifically iron ore. The legal intervention guaranteed the legal viability of the project and security in the exploitation of the resource, ensuring compliance with applicable mining and environmental regulations.
  • Represented a company in the tequila sector in the defense of its trademark rights against the claim of a third party, having proven the non-existence of risk of confusion, obtaining the definitive ownership of the exclusive registration. 
  • We represented a company in the industrial sector that was improperly sanctioned for the handling of hazardous waste and atmospheric emissions. During the proceeding, irregularities were detected in the actions of the authority, and we were able to prove the illegality of the determinations and obtain the refund of the payments made. 
  • We were able to get the National Water Commission to allow a taxpayer to accept the transfer of a water use concession by a means other than the water mailbox, because he did not have access to it, proving that the legislation does not require that the acceptance be made exclusively through said means.
