A citizen filed a lawsuit for patrimonial responsibility after the loss of his vehicle, which was sent to the vehicle impound without proof of entry. The court determined the liability of the public administration for omission in its duty of custody, proving the material damage. Initially a compensation of $46,223.10 was fixed, but after an amparo trial, a fair amount of $101,836.55 was recognized. The case reaffirms the State's duty to repair damages caused by its irregular activity, without requiring malice or fault.
A client was facing a fine from the STPS of close to half a million pesos, derived from alleged irregularities in personnel administration. At MNP Consultores we detected deficiencies in the procedure and filed a nullity suit before the TFJA. The Court determined that the authority had exceeded the legal deadlines, declaring the resolution null and void.
